Terms of Use
This is a reference translation. The Japanese text is the authoritative version of these Terms; where the two differ, the Japanese governs.
These Terms set out the conditions for using Peeksy (the “Service”). By using the Service you are deemed to have agreed to these Terms. The Service’s Privacy Policy forms part of these Terms.
1. What the Service does
The Service lets you record your own screen (such as your YouTube home feed), and save and share the recommendation cards extracted from that recording as snapshots or canvases. Supported platforms and features may change from time to time as the Service is improved.
2. Eligibility
The Service is intended for people aged 13 and over. Minors may use it only with the consent of a parent or other legal representative. You represent and warrant that you have the legal capacity to agree to these Terms.
3. Accounts
Using the Service requires signing in with a Google or Apple account. You are responsible for managing your own account.
4. Prohibited conduct
- Recording or posting another person’s account or screen without their consent
- Infringing third-party rights (copyright, likeness, privacy, and so on)
- Posting content that violates law or public order and morals
- Interfering with the operation of the Service (unauthorised access, excessive automated access, and so on)
You must also not post harassing, threatening, discriminatory, obscene, or otherwise inappropriate or unlawful content (“Objectionable Content”). The operator has zero tolerance for Objectionable Content and may, upon receiving a report or discovering such content itself, promptly (as a guide, within 24 hours) remove it and suspend the posting account or take other measures.
5. Rights in, and licence to, your content
You retain the rights in the snapshots, canvases, comments, and other content you post to the Service (“Your Content”). Thumbnail images, video titles, and channel names contained in a snapshot belong to YouTube and to their respective rights holders.
You grant the operator a royalty-free, non-exclusive, worldwide, sublicensable licence to store, reproduce, crop, generate thumbnails from, convert, distribute, and display Your Content to the extent necessary to do so on the Service. That licence is limited to providing, operating, maintaining, and improving the Service and to fixing faults, and is exercised in accordance with the visibility you chose (Only You / Friends / Public). If you delete Your Content, the operator will stop using it within a reasonable period, except where it temporarily remains in backups and the like.
If the operator intends to use Your Content for a purpose not stated in this clause — such as analytics, technical development using artificial intelligence or machine learning, or provision to third parties — it will do so only after giving notice in advance and obtaining the necessary consent, in accordance with the Privacy Policy.
6. Reporting infringement
If you believe posted content infringes your copyright or other rights, you may report it to the contact address at the end of these Terms, including information identifying the content, evidence that you are the rights holder, the reason it is infringing, and your contact details. The operator will review the report and, where it considers it necessary, hide or remove the content or take other measures. Accounts that repeatedly infringe may be suspended or deleted.
7. Your responsibilities for recording and third-party services
When recording or posting screens from YouTube or other third-party services, you will comply with those services’ terms of use and any other applicable terms and guidelines. You warrant that you hold the rights or title necessary for what you record and post, and you must not record or post another person’s account screen, non-public information, or any screen containing third-party rights without proper title. The Service is not affiliated with, sponsored by, or endorsed by YouTube LLC or Google LLC, and is operated independently. YouTube and other marks are trademarks of their respective owners.
8. Disclaimer
The Service is provided as is. The operator does not warrant its completeness, accuracy, usefulness, or fitness for a particular purpose, nor that it will be provided without interruption.
For damage you suffer through the operator’s slight negligence (that is, other than intent or gross negligence), whether in breach of contract or in tort, the operator is liable only for direct and ordinary damage that would normally arise, and is not liable for lost profits or other damage arising from special circumstances, whether or not foreseeable. This limitation does not apply where the operator acted with intent or gross negligence. Where the Consumer Contract Act or other mandatory law does not permit the operator’s liability to be excluded or limited, this clause does not apply to the extent it would conflict with that law.
9. Indemnity
If your breach of these Terms, Your Content, or your use of the Service gives rise to a dispute with a third party, or results in a claim against the operator by a third party, you will resolve it at your own cost and responsibility and will compensate the operator for the loss it suffers, including reasonable legal fees.
10. Apple-specific terms
The following apply to your use of the Service as an iOS app.
- These Terms are concluded between you and the operator. Apple Inc. is not a party to them. The operator, not Apple, is responsible for the app and its content.
- Maintenance and support for the app are provided by the operator; Apple has no such obligation.
- The operator, not Apple, is responsible for product liability, legal compliance, consumer protection, and any claim that the app infringes third-party intellectual property rights.
- Apple Inc. and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, may enforce them directly against you.
- You represent that you are not located in a country subject to a U.S. Government embargo and are not listed on any U.S. Government prohibited or restricted party list.
11. Changes to these Terms; discontinuation
These Terms may be changed as necessary. The operator may also discontinue all or part of the Service after giving advance notice.
12. General
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force. These Terms constitute the entire agreement between you and the operator regarding use of the Service. The operator may transfer its position under these Terms to a third party in connection with a business transfer or a similar event. Clauses 5 through 9, and any other clause that by its nature should survive, survive termination of these Terms. The Japanese text of these Terms is the authoritative version.
13. Governing law and jurisdiction
These Terms are governed by the laws of Japan. Any dispute concerning the Service is subject to the exclusive jurisdiction of the court having jurisdiction over the operator’s location.
